Question: What is the better way next step for Afghan admitted about Aug 30, 2021, received I 766 Employment Authorization Document for 2 years in category C11, to Adjust Status (AOS) to apply for Green Card? or apply for asylum I 589? or ?

Does this TPS residence since date March 15th mean that if they arrived before March 15th, say like March 2nd - they wouldn't be eligible?
Andrea Provins
43:21
Backing up to the previous slide, if the client doesn't maintain an F-1 status after an asylum packet has been submitted for extraordinary circumstances, would that cause issues?
Bashar Karim

Thank you

For rare cases with EADs expiring after one year, do you recommend applying for TPS?

thank you David!

I tell clients "residence" means your home is in the US and "physical presence" means your body is in the US.
Ariel LIRA
01:07:49
How could you explain your home being in the US but not your body?
David Spicer (USCCB)
01:07:59
Please see page 2 for discussion on continuous residence versus physical presence: https://www.aila.org/File/Related/21081232b.pdf

What categories eligible for adjustment of status AOS? Special Immigrant Visa (SIV) after approved I 360, I suppose? who, if anyone, paroled in eligible for AOS?
STEPHANIE ORTEGA
01:09:14
For case with only 1 year parole grant: I recommend checking electronic I-94. I had an Afghan client paroled for 1 year (under "DT" not "OAR" code), back when they were only giving 1 year to Afghans, and when we checked his I-94 months later, it was automatically changed to 2 years!
Sarah Wheeler
01:10:18
That's so helpful, thank you Elisabeth!

I believe that there may be state benefits available to TPS registrants also.

Except as provided in the paragraph below, if a bureau has previously adjudicated and granted parole to anindividual, the issuing bureau should, in the interest of efficiency, adjudicate requests for re-parole, unless(1) the circumstances or intent of the parole have changed such that additional factors render the bureauinappropriate to adjudicate the new application, or (2) another bureau agrees to assume a particularcaseload in the interest of expediency or settled local practice.
